Motion by the Mark Diamond, Esq., the attorney assigned to represent the appellant Joseph B. on an appeal from an order of the Family Court, Kings County, dated September 16, 2003, to be relieved. The motion for assignment of counsel was granted on March 29, 2004.

Upon the papers filed in support of the motion and no papers having been filed in opposition to or in relation thereto, it is

ORDERED that on the court's own motion the appellant Joseph B. is directed to show cause why an order should or should not be entered dismissing his appeal as abandoned by filing an affidavit on that issue in the office of the Clerk of this court, and serving one copy of the same on his attorney and on the remaining parties, on or before September 17, 2004; and it is further,

ORDERED that the motion to be relieved is held in abeyance in the interim; and it is further,
