DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Queens County, dated December 14, 2004, inter alia, to enlarge the record to include the package of papers allegedly submitted to the Supreme Court on or about October 15, 2004. By decision and order on motion of this court dated May 27, 2005, that branch of the motion which is to enlarge the record on appeal to include the package of papers allegedly submitted to the Supreme Court on or about October 15, 2004, was remitted to the Supreme Court, Queens County, to report on the issue of whether it considered the aforementioned papers in rendering the order dated December 14, 2004, and that branch the motion was held in abeyance in the interim. The Supreme Court has filed its report.

Upon the papers filed in support of the motion and the papers filed in opposition or relation thereto, and upon the report of the Supreme Court, Queens County, it is

ORDERED that the branch of the motion which is to enlarge the record on appeal to include the package of papers allegedly submitted to the Supreme Court on or about October 15, 2004, is denied as unnecessary as the report of the Supreme Court indicates that it reviewed the foregoing material and it is properly part of the record on appeal; and it is further,

ORDERED that on the court's own motion, the appellant's time to perfect the appeal is enlarged until October 31, 2005, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date; and it is further,

ORDERED that no further enlargements of time shall be granted.
