| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to appeal to the Court of Appeals from a decision and order of this court dated January 5, 2010, which determined appeals from an order of the Supreme Court, Nassau County, dated May 12, 2008, and a judgment of the same court entered July 18, 2008, to extend the time to provide certain papers, or, in the alternative, in effect, for leave to reargue the decision and order of this court, to rescind the award of costs, and to clarify the decision and order dated January 5, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, with $100 costs.
