Motion by the appellant, in effect, for leave to reargue an appeal from an order of the Supreme Court, Nassau County, dated September 30, 2008, which was determined by decision and order of this court dated January 5, 2010, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order dated January 5, 2010, to extend the time to provide certain papers, to rescind the award of costs in the decision and order of dated January 5, 2010, and to clarify the decision and order dated January 5, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, with $100 costs.
