Motion by the appellant to enlarge the time to serve and file a reply brief on an appeal from an order of the Supreme Court, Kings County, dated January 22, 2009, and to waive the motion filing fee.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a reply brief is dismissed without prejudice to renewing the motion on or before March 30, 2012, upon payment of the motion filing fee (see CPLR 8022[b]).
