Motion by the appellant on an appeal from a judgment of the Supreme Court, Dutchess County, dated March 2, 2012, for leave to reargue his prior motion for leave to prosecute the appeal as a poor person and for the assignment of counsel, which was determined by decision and order on motion of this Court dated May 15, 2012.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
