| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to recall and vacate so much of a decision and order on motion of this Court dated July 29, 2013, as dismissed an appeal from an order of the Supreme Court, Kings County, dated May 18, 2012, for failure to timely perfect, to reinstate the appeal, for poor person relief, and to waive the motion filing fee.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the appellant's motion which is to waive the motion filing fee is denied as unnecessary; and it is further,
ORDERED that the motion is otherwise denied.
