| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to appeal to the Court of Appeals from a decision and order on motion of this Court dated August 26, 2016,which, inter alia, dismissed an appeal from an order of the Supreme Court, Kings County, dated May 7, 2015, for poor person relief, and to waive the motion filing fee.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the appellant's motion which is to waive the motion filing fee is denied as unnecessary (see CPLR 8022[b]); and it is further,
ORDERED that the motion is otherwise denied.
