Motion by the appellant, inter alia, to recall and vacate so much of a decision and order on motion of this Court dated February 8, 2011, as dismissed an appeal from an order of the Supreme Court, Kings County, dated July 8, 2009, for failure to timely perfect and to extend the time to perfect the appeal, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order on motion of this Court dated February 8, 2011.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
