| DECISION & ORDER ON MOTION |
Proceeding pursuant to CPLR article 78, inter alia, to void and invalidate certain proceedings in a matter entitled Altiner v Ates, commenced in the Supreme Court, Suffolk County, under Index No. 7928/2016. By decision and order on motion of this Court dated October 22, 2021, the petitioner was directed to pay the filing fee within 120 days of the date of that decision and order on motion. The petitioner has failed to pay the filing fee.
Now, on the Court's own motion, it is
ORDERED that the proceeding is dismissed, without costs or disbursements, for failure to pay the filing fee as directed by the decision and order on motion of this Court dated October 22, 2021.
