Appeal from a judgment of the Supreme Court, Queens County, rendered June 28, 1985, which was dismissed by decision and order on motion of this Court dated December 23, 1996, as abandoned. Motion by the appellant, in effect, to recall and vacate the decision and order on motion of this Court dated December 23, 1996, for leave to reinstate the appeal, for leave to prosecute the appeal as a poor person, and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied.
