Appeal from a judgment of the Supreme Court, Queens County, rendered February 8, 2019. Motion by the appellant for leave to serve and file a supplemental brief raising an issue concerning multiplicitous counts.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, and on or before April 22, 2022, the appellant may serve and file a supplemental brief raising an issue concerning multiplicitous counts via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the supplemental brief and upload a digital copy of the supplemental brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief in response to the supplemental brief filed by assigned counsel is extended until May 23, 2022, and the respondent's brief, if any, must be served and filed on or before that date via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website.
