DECISION & ORDER ON MOTION

The People of the State of New York, Appellant, v Wilmer Bueso, Respondent.

Motion by Mark Muccigrosso, Esq., for leave to withdraw as counsel for respondent on the People's appeal from an order of the City Court of Port Jervis, Orange County, entered November 18, 2020.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to withdraw as counsel is granted, and on or before April 29, 2022, Mark Muccigrosso, Esq., shall serve his client, by one of the methods specified in CPLR 2103 (c), with a copy of this decision and order on motion and shall file proof of such service with the clerk of this court; and it is further,

ORDERED that no further proceedings shall be taken against respondent, without leave of this court, until the expiration of 30 days after the service upon him of a copy of this decision and order on motion; and it is further

ORDERED that the branch of the motion seeking assignment of counsel is denied without prejudice to renew upon the filing of an application by respondent establishing his entitlement to assigned counsel; and it is further

ORDERED that the branch of the motion seeking an extension of time to serve and file a respondent's brief is granted, and respondent shall serve and file a respondent's brief on or before June 10, 2022
