DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Queens County, dated December 3, 2021, which was dismissed by decision and order on motion of this Court dated January 26, 2022, on the ground that no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 4 and leave to appeal had not been granted. Motion by the appellant to vacate the dismissal of the appeal, and for poor person relief and assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to vacate the dismissal of the appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
