| DECISION & ORDER ON MOTION |
Appeals from two orders of the Family Court, Queens County, both dated April 29, 2021. Motion by the respondent Lisa K. A., in effect, to make the caption anonymous, to strike stated portions of the appellant's brief on the ground that they contain improper or prejudicial statements, to strike the brief of the respondent Scott A. on the ground that it refers to matter dehors the record, and to extend the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to strike the brief of the respondent Scott A. is granted to the extent that the first and second full paragraphs on page 3 of the brief are stricken, and on or before June 6, 2022, the respondent Scott A. shall serve and file a replacement brief that does not contain the stricken material and is in other respects the same as the brief previously filed, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the replacement brief and upload a digital copy of the replacement brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that the branch of the motion which is to extend the time to serve and file a brief is granted, and on or before July 6, 2022, the respondent Lisa K. A. shall serve and file her brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve her brief and upload a digital copy of her brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that the motion is otherwise denied.
