Respondent having moved to dismiss the appeal or, in the alternative for an extension of time to file a brief taken herein from an order of the Supreme Court, Monroe County, entered January 6, 2022,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to dismiss the appeal is denied without prejudice and leave to renew any contentions in support of or in opposition to the motion in the briefs that remain outstanding and at oral argument, and
It is further ORDERED that the motion is granted insofar as it seeks time for respondent to file and serve a brief in accordance with this Court's rules, and the time is extended to June 16, 2022.
