DECISION & ORDER ON MOTION

Boris Zats and Marina Shafir Zats, Appellants, v Arkadi Katselnik, Also Known as Ark Katselnik, and 139 Cobb Road, LLC, Respondents.

Motion by appellant to vacate an order of this court dated December 20, 2021, which dismissed the appeal from orders of the Civil Court of the City of New York, Kings County, entered February 24, 2021 and March 9, 2021, respectively.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion to vacate dismissal is granted on condition plaintiff perfects the appeal on or before July 8, 2022; and it is further,

ORDERED that in the event the appeal is not perfected by July 8, 2022, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may serve such application upon appellant in person.
