v Frederick Piesco, Jr., respondent.

(Index No. 687/2013)

DECISION & ORDER ON MOTION

Appeals from a judgment, and from findings of fact and conclusions of law of the Supreme Court, Rockland County, both dated November 9, 2021. Motion by the appellant, inter alia, to stay enforcement of the judgment, pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the appeal from the findings of fact and conclusions of law is dismissed, without costs or disbursements, on the ground that no appeal lies from findings of fact and conclusions of law (see Schicchi v J.A. Green Constr. Co., 100 AD2d 509); and it is further,

ORDERED that the motion is denied.

DUFFY, J.P., BARROS, RIVERA and MILLER, JJ., concur.
