| DECISION & ORDER ON MOTION |
Appeal from an order of the Family Court, Suffolk County, dated October 27, 2021, which was dismissed by decision and order on motion of this Court dated December 17, 2021. Motion by the appellant, in effect, to vacate the decision and order on motion of this Court dated December 17, 2021, or, in the alternative, for leave to appeal from the order, to dismiss the underlying proceeding, or in the alternative, to stay the above-entitled proceeding, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branches of the motion which are, in effect, to vacate the decision and order on motion of this Court dated December 17, 2021, or, in the alternative, for leave to appeal from the order are denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
