DECISION & ORDER ON MOTION

Upon the Court's own motion, it is

ORDERED that the decision and order on motion in the above-entitled matter dated July 21, 2021, is recalled and vacated, and the following decision and order on motion is substituted therefor:

Motion by Larry Hallock for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Hallock was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 20, 1992. By opinion and order of this Court dated February 13, 2020, Mr. Hallock was suspended from the practice of law for a period of one year, effective March 16, 2020. By order dated December 14, 2021, the Court of Appeals reversed the opinion and order dated February 13, 2020, and remitted the matter to this Court for further proceedings in accordance with its determination. Upon remittitur, by decision and order decided herewith, this Court concluded that reciprocal discipline is warranted and suspended the respondent from the practice of law for a period of one year, nunc pro tunc to March 16, 2020.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion for reinstatement is held in abeyance, and the matter is referred to a Committee on Character and Fitness to investigate and report on Larry Hallock's character and fitness to practice law.

LASALLE, P.J., DILLON, DUFFY, BARROS and RIVERA, JJ., concur.
