| DECISION & ORDER ON MOTION |
Upon the Court's own motion, it is
ORDERED that the decision and order on motion in the above-entitled matter dated November 4, 2020, is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by Mary Malerba for reinstatement to the Bar as an attorney and counselor-at-law. Ms. Malerba was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 21, 2004. By opinion and order of this Court dated February 13, 2020, Ms. Malerba was suspended from the practice of law for a period of six months, effective March 16, 2020. By order dated December 14, 2021, the Court of Appeals reversed the opinion and order dated February 13, 2020, and remitted the matter to this Court for further proceedings in accordance with its determination. Upon remittitur, in a decision and order decided herewith, this Court concluded that reciprocal discipline is warranted and suspended the respondent from the practice of law for a period of six months, nunc pro tunc to March 16, 2020.
Upon the papers filed in support of the motion and the papers filed in response thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that, effective November 4, 2020, Mary Sheila Malerba is reinstated as an attorney and counselor-at-law, and the Clerk of the Court is directed to restore the name of Mary Sheila Malerba to the roll of attorneys and counselors-at-law, as of that date.
