DECISION & ORDER ON MOTION

2021-09185

Nicholas H. Doering, appellant,

v Vesna Oelsner, et al., respondents.

(Index No. 606130/2020)

Appeals from two orders of the Supreme Court, Nassau County, dated September 22, 2021, and November 23, 2021, respectively. Motion by the appellant, inter alia, to consolidate the appeals, in effect, to stay enforcement of so much of the order dated September 22, 2021, as vacated an order of the same court dated May 27, 2021, and to stay all discovery in the above-entitled action, pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to consolidate the appeals is denied as unnecessary as the appeals may be consolidated as of right (see 22 NYCRR 1250.9[f][3]); and it is further,

ORDERED that the motion is otherwise denied.

BARROS, J.P., CHAMBERS, VOUTSINAS and WAN, JJ., concur.
