DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Robert Nevins, Appellant.

Motion by appellant, pursuant to CPL 460.30, for an extension of time to file an affidavit of errors on an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered July 23, 2021.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and defendant shall serve and file his affidavit of errors within 30 days of the date of this Decision & Order on Motion; and it is further,

ORDERED that on the court's own motion, that the appeal be perfected on or before October 31, 2022; and it is further,

ORDERED that in the event the appeal is not perfected by October 31, 2022, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may serve such notice upon the appellant in person.
