The People of the State of New York, Respondent, v Richard J. Molloy, Appellant.

Motions by Richard L. Herzfeld, Esq., counsel assigned to represent appellant on appeals from judgments of conviction of the Justice Court of the Town of Somers, Westchester County, rendered March 22, 2021, to be relieved as counsel on the ground that appellant has abandoned the appeals by failing to respond to correspondence sent to him by assigned counsel. By orders to show cause dated April 15, 2022, appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeals on the ground that he had abandoned the appeals by failing to respond to correspondence sent to him by assigned counsel, and the motions by assigned counsel to be relieved were held in abeyance in the interim.

Upon the orders to show cause and no papers having been filed in response thereto, and upon the papers filed in support of the motions by assigned counsel and no papers having been filed in opposition thereto, it is

ORDERED that, on the court's own motion, the motions are consolidated for purposes of disposition; and it is further

ORDERED that the motions to dismiss the appeals are granted and the appeals are dismissed; and it is further,

ORDERED that the motions by assigned counsel to be relieved are granted.
