DECISION & ORDER ON APPLICATION

Application by the defendant pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from an order of the Supreme Court, Queens County, dated October 18, 2021, which has been referred to me for determination.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the branch of the application which is for a certificate granting leave to appeal to this Court from so much of the order and judgment as denied the appellant's motion pursuant to CPL 440.10 is denied; and it is further,

ORDERED that the branch of the application which is for a certificate granting leave to appeal to this Court from so much of the order and judgment as dismissed the appellant's petition for a writ of habeas corpus is denied as unnecessary as that portion of the order and judgment is appealable as of right.
