ORDERED that the decision and order on motion of this Court dated April 18, 2022, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Appeals from two orders of the Supreme Court, Queens County, both dated December 17, 2018. Motion by the respondent to dismiss the appeals as academic. Cross motion by the appellant, inter alia, to allow the appeals to proceed.
Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion and cross motion are held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof.
