ORDERED that the decision and order on motion of this Court dated October 17, 2022, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:

Appeal and cross appeal from an order of the Supreme Court, Nassau County, entered April 16, 2021. Motion by the respondents-appellants for leave to serve and file their brief under seal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the Court's own motion, the respondents-appellants' time to serve and file an answering brief is extended, and on or before November 21, 2022, the respondents-appellants shall serve and file the respondents-appellants' answering brief, including the points of argument on the cross appeal (see 22 NYCRR 1250.9[f][1][iv]) via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the answering brief and upload a digital copy of the answering brief, with proof of service thereof, through the digital portal on this Court's website.
