DECISION & ORDER ON MOTION

Motion by Andre Johnson for leave to appeal to this Court from an order of the Supreme Court, Kings County, dated June 21, 2022, for leave to prosecute the appeal as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal to this Court from the order is denied, as the order is neither appealable as of right nor by permission (see CPL 450.10, 450.15); and it is further,

ORDERED that the motion is otherwise denied as academic.
