Appeal by Richard A. Johnson from a judgment of the County Court, Dutchess County, rendered August 16, 2022, upon a plea of guilty. Motion by the appellant pro se for leave to prosecute the appeal as a poor person and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied as unnecessary in light of the decision and order on motion of this Court dated November 9, 2022, which granted poor person relief and assigned counsel to prosecute the appeal pursuant to Criminal Procedure Law § 380.55(2).
