| DECISION & ORDER ON MOTION |
Proceeding pursuant to CPLR article 78, which was transferred to this Court by order of the Supreme Court, Suffolk County, dated August 8, 2022. Motion by the petitioner to stay enforcement of the decision of appeal of the State of New York Department of Motor Vehicles Appeals Board, dated April 5, 2022, which suspended the petitioner's driver's license for a period of 180 days, pending hearing and determination of the proceeding.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted and enforcement of the decision of appeal of the State of New York Department of Motor Vehicles Appeals Board, dated April 5, 2022, is stayed, pending hearing and determination of the proceeding on condition that the proceeding is perfected on or before December 27, 2022; and it is further,
ORDERED that in the event the proceeding is not perfected on or before December 27, 2022, the Court, on its own motion, may vacate the stay, without further notice, or the respondents may move to vacate the stay, on three days notice.
