DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Kings County, rendered February 25, 2009. By decision and order on motion of this Court dated December 13, 2021, the motion of the appellant pro se for leave to serve and file a supplemental brief was granted. By decision and order on motion of this Court dated July 29, 2022, the motion of the appellant pro se for an extension of time to serve and file the supplemental brief was granted.

On the Court's own motion, it is

ORDERED that the decision and order on motion of this Court dated December 13, 2021, is recalled and vacated, and the motion for leave to serve and file a pro se supplemental brief is denied.

The appellant has failed to file a pro se supplemental brief although afforded sufficient opportunity to do so.
