Appellant having moved pursuant to CPL 460.10 (6) to amend the notice of appeal previously filed and served from a judgment of the Ontario County Court, rendered June 16, 2021, and for other relief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the notice of appeal dated April 16, 2021 is hereby amended to include the judgment rendered under indictment 20-01-010, and as amended such notice of appeal shall be deemed as timely filed and served (see CPL 460.10[6]); and,
It is further ORDERED that the order entered September 8, 2021 assigning counsel and granting poor person status shall be amended to include appellant's appeal from the judgment rendered under indictment 20-01-010.
