It is hereby ORDERED that the motion is dismissed as unnecessary.
Memorandum: The People concede that defendant has not been served with the decision and order dismissing without prejudice defendant's application for resentencing under CPL 40.47, and thus his 30-day period in which to file an appeal, if any, to this Court has not expired(see CPL 460.10 [1][a]; 460.10 [4][a]).
