DECISION & ORDER ON MOTION

Motion by respondent to dismiss an appeal from an order of the Civil Court of the City of New York, Queens County, dated August 24, 2021, or, in the alternative, to direct appellant to serve and file a corrected record on appeal and to enlarge the time to serve and file a respondent's brief. Cross motion by appellant for leave to serve and file a supplemental record on appeal.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that the branches of respondent's motion seeking to dismiss the appeal or to direct appellant to file a corrected record are denied; and it is further,
ORDERED that appellant's cross motion for leave to serve and file a supplemental record is granted, and appellant shall file the supplemental record within 30 days of the date of this decision and order on motion; and it is further,
ORDERED that the branch of respondent's motion seeking an enlargement of time to serve and file a respondent's brief is granted, and the respondent's brief shall be served and filed within 21 days of the date that the supplemental record is due to be filed pursuant to this decision and order; and it is further,
ORDERED that appellant, if he be so advised, may serve and file a reply brief within 7 days of the date that respondent's brief is served and filed.
