2020-00899 Deutsche Bank National Trust Company, etc., respondent, v Pamela Merrill, appellant, et al., defendants. (Index No. 704031/2016)
| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Queens County, dated November 8, 2019. By order to show cause dated October 14, 2022, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the right of direct appeal from the order dated November 8, 2019, terminated upon entry in the above-entitled action of an order and judgment (one paper) of the Supreme Court, Queens County, dated July 28, 2022.
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion is granted and the appeal is dismissed, without costs or disbursements (see Matter of Aho, 39 NY2d 241).
CONNOLLY, J.P., WOOTEN, ZAYAS and WARHIT, JJ., concur.
