DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Queens County, rendered March 29, 2005, which was determined by decision and order of this Court dated December 11, 2007. Motion by the appellant pro se for leave to reargue the appeal, for leave to prosecute the appeal as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to reargue the appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
