| DECISION & ORDER ON MOTION |
Motion by Joseph Michael Rizzo for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Rizzo was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on February 19, 1992. By opinion and order dated January 16, 2007, this Court disbarred Mr. Rizzo effective immediately based upon his conviction of scheme to defraud in the first degree, in violation of Penal Law § 190.65(1)(b), a class E felony.
Upon the papers filed in support of the motion and the papers filed in relation thereto,
it is
ORDERED that the motion is denied.
We find that Joseph Michael Rizzo does not demonstrate the requisite character and fitness to practice law.
