| DECISION & ORDER ON MOTION |
Motion by Ritania Lamour for leave to appeal to this Court from a decision and order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated October 15, 2021, which determined an appeal from an order of the Civil Court of the City of New York, Kings County, entered March 19, 2019, and to stay enforcement of the decision and order, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this Court from the decision and order is granted; and it is further,
ORDERED that the branch of the motion which is to stay enforcement of the decision and order is granted, and enforcement of the decision and order is stayed, pending hearing and determination of the appeal on condition that the appeal is perfected on or before January 23, 2023; and it is further,
ORDERED that in the event the appeal is not perfected on or before January 23, 2023, the Court, on its own motion, may vacate the stay, without further notice, or the respondents may move to vacate the stay on three days notice.
