ORDERED that the appeal is transferred to the Appellate Division of the Supreme Court in the First Judicial Department for determination (see NY Const, art VI, §§ 4[a], 5[b]; Court of Claims Act § 24; CPLR 5711); and it is further,
ORDERED that all further proceedings in connection with the appeal shall be conducted pursuant to the rules of the Appellate Division of the Supreme Court in the First Judicial Department.
