Petitioner-appellant having applied for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Oneida County, entered March 7, 2022,

An order having been entered on May 3, 2022, granting petitioner-appellant's application to perfect an appeal taken herein as a poor person and assigning Steven G. Cox, Esq., as counsel to perfect the appeal,

Now, upon reading and filing the statement of Steven G. Cox, Esq., dated September 30, 2022, and due deliberation having been had thereon,

It is hereby ORDERED that Kathryn Festine, Esq., 258 Genesee Street, Suite 307, Utica, New York 13502, is hereby substituted as counsel to conduct the above-entitled appeal taken from an order of the Family Court, Oneida County, entered March 7, 2022, in place and stead of Steven G. Cox, Esq., and

It is further ORDERED that the Oneida County Family Court Clerk provide Kathryn Festine, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and

It is further ORDERED that the time to perfect the appeal is extended to February 3, 2023, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
