An appeal having been taken herein from an order of the Supreme Court, Cattaraugus County, entered August 16, 2022, and defendants having moved to seal exhibits A, B, and C of an affidavit signed by Keri Spring dated May 24, 2022, which is anticipated to be part of the record on this appeal once perfected, on the ground that the exhibits contain a date of birth which is confidential personal information pursuant to 22 NYCRR 202.5 (e), and
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied, without prejudice and leave to renew, on the ground that such relief appears to be unnecessary because the parties are required to omit or redact dates of birth pursuant to 22 NYCRR 202.5 (e) (1) (ii).
Memorandum: This motion is denied without prejudice to a new motion that demonstrates why it is necessary and appropriate to seal the entirety of the exhibits listed.
