ORDERED that the decision and order on motion dated January 4, 2023, in the above-entitled appeal is recalled and vacated, and the following decision and order on motion is substituted therefor:
Appeal from a judgment of the County Court, Orange County, rendered November 15, 2022. Motion by the appellant pursuant to CPL 460.50 for a stay of execution of said judgment, and to be released on his own recognizance or, in the alternative, to fix reasonable bail.
