Respondent having moved to strike memoranda of law from the record on appeal taken herein from an order of Supreme Court, Erie County, entered January 20, 2022, and to strike any reference thereto in appellant's brief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to strike the memoranda of law from the record on appeal and to strike appellant's brief is granted, and
It is further ORDERED that appellant is to file and serve a corrected brief in accordance with this Court's rules on or before January 24, 2023, and
It is further ORDERED that the motion insofar as it seeks extension of time for respondent to file a brief is granted, on the condition that the brief is filed and served in accordance with this Court's rules on or before February 6, 2023.
