DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Westchester County, dated June 16, 2021. Motion by the appellant to enlarge the record to include the transcripts of certain proceedings.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the order on certification of this Court dated September 8, 2021, which granted poor person relief to the appellant, is amended to include a direction to the court reporter to make, certify and file two transcripts of the stenographic minutes of the proceedings which occurred in Supreme Court, Westchester County, on August 14, 2019, and August 16, 2019, in the above-entitled matter, if available; and it is further,

ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings, if any, except for those minutes previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the clerk of the Supreme Court, Westchester County, and the clerk of the Supreme Court, Westchester County shall furnish one of such certified transcripts to the appellant's counsel, Law Offices of Joan Iacono, 2 Overhill Road, Ste. 400, Scarsdale, New York 10583, without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Supreme Court, Westchester County and one transcript shall be delivered to the appellant's assigned counsel; assigned counsel is directed to turn over the transcript to all of the other parties to the appeal, including the attorneys for the children, when counsel serves the appellant's brief upon those parties; and it is further,

ORDERED that assigned counsel is directed to serve a copy of this decision and order on motion upon the clerk of the court from which the appeal is taken.
