Appellant Robert T. Grunwald having moved to vacate the dismissal of the appeal taken herein from an order of Supreme Court, Erie County, entered May 24, 2022 (docket No. CA 22-1077) and to consolidate the appeal in docket No. CA 22-1077 with Pioneer Central School District's appeal from a separate order of Supreme Court, Erie County entered May 24, 2022 (docket No. CA 22-01031),
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to vacate dismissal of the appeal in docket No. CA 22-01077 is granted on the condition that the appeal is perfected on or before February 27, 2023, and
It is further ORDERED that the motion insofar as it seeks to consolidate the appeals is granted for the purposes of perfecting and arguing the appeals.
