| ORDER TO SHOW CAUSE |
Appeal from an order of the Supreme Court, Nassau County, dated September 24, 2019. The appellants perfected their appeal on September 21, 2020, and the respondent filed its brief on October 28, 2020. The matter was placed on the calendar for January 20, 2023. After 5:00 p.m. on January 19, 2023, counsel for the appellants submitted a letter to this Court via fax, advising this Court that the appeal was stayed pursuant to 11 USC § 362(a), as counsel for the appellants had filed a bankruptcy petition on behalf of the appellant Garrett Tupper on December 5, 2022.
Now, on the Court's own motion, it is
ORDERED that Ronald D. Weiss, P.C., counsel for the appellants, and Friedman Vartolo LLP, counsel for the respondent, are directed to show cause before this Court why an order should or should not be made and entered imposing such sanctions and/or costs, if any, against Ronald D. Weiss, P.C., pursuant to 22 NYCRR 1250.2(c) as this Court may deem appropriate, by each serving and filing an affirmation or affidavit on that issue, via NYSCEF, on or before February 27, 2023; and it is further,
ORDERED that the Clerk of this Court, or her designee, is directed to serve a copy of this order to show cause by uploading a copy of this order to show cause to the NYSCEF system.
