Appeal from an order of the Family Court, Dutchess County, dated December 15, 2022. Motion by the appellant for leave to appeal to this Court from the order and to stay enforcement of the order, pending hearing and determination of the appeal. Separate motion by the appellant for leave to prosecute the appeal as a poor person and for the assignment of counsel
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this Court from the order is denied; and it is further,
ORDERED that the appeal purportedly taken as of right is dismissed, without costs or disbursements; and it is further,
ORDERED that the branch of the motion which is to stay enforcement of the order pending hearing and determination of the appeal is denied as academic; and it is further,
ORDERED that the motion for leave to prosecute the appeal as a poor person and for the assignment of counsel is granted to the extent that the motion filing fees are waived and that motion is otherwise denied.
