DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Kings County, dated August 25, 2020. By decision and order on motion dated November 20, 2020, this Court, inter alia, granted that branch of the appellant's motion which was to stay the parties to the above-entitled matter and the parties to the action entitled NYCTL 2017-A Trust v Robinson, commenced in the Supreme Court, Kings County, under Index No. 507623/2018, from selling transferring, altering, encumbering, or taking any action with respect to the subject premises, pending hearing and determination of the appeal. Motion by the appellant to clarify the decision and order on motion of this Court dated November 20, 2020, or, in the alternative, to modify it to the extent of permitting the appellant to take certain actions, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that the decision and order on motion of this Court dated November 20, 2020, is modified to permit the appellant to pay the carrying costs and to effectuate necessary repairs to and maintenance of the subject premises, pending hearing and determination of the appeal, and the motion is otherwise denied.
