DECISION & ORDER ON MOTION

Proceeding pursuant to CPLR article 78 in the nature of mandamus to compel the respondent Joy Campanelli, a Justice of the Supreme Court, Kings County, to determine a motion in an action entitled Hirsch v Yisraeli, pending in that court under Index No. 507755/2022. Application by the petitioner for poor person relief and the assignment of counsel.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application for poor person relief and the assignment of counsel is denied; and it is further,

ORDERED that on the Court's own motion, in the event that the filing fee has not been paid within 120 days from the date of this decision and order on motion, the proceeding shall be dismissed (see CPLR 1101[d]; 8022[b]; 22 NYCRR 1250.17[a][1]).
