Motion by Joseph Falbo, Jr., Esq., for leave to withdraw as counsel for respondent on an appeal from an order of the District Court of Suffolk County, First District, dated May 26, 2021.
Upon the papers filed in support of the motion and the papers filed in response thereto, it is
ORDERED that the motion is granted, and Joseph Falbo, Jr., Esq., is relieved from representing respondent with respect to the appeal and is directed to turn over all papers, including the transcripts, if any, to respondent; and it is further,
ORDERED that on or before March 13, 2023, Joseph Falbo, Jr., Esq., shall serve his client, by one of the methods specified in CPLR 2103 (c), with a copy of this decision and order on motion and shall file proof of such service with the clerk of this court; and it is further,
ORDERED that no further proceedings shall be taken against the respondent, without leave of the court, until the expiration of 30 days after service upon the respondent of a copy of this decision and order on motion.
